Terms of Service

By accessing or using HomesBuyer ("Platform") at homesbuyer.in or homesreality.in, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

These Terms apply to all visitors, registered users, property buyers, renters, property owners, brokers, service professionals, and any other person who accesses or uses the Platform.

By registering an account, posting a property, or submitting a lead enquiry, you confirm that you have read, understood, and agree to these Terms.

We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.

HomesBuyer is an online real estate marketplace that connects property buyers and renters with property owners and brokers primarily across Navi Mumbai — including Ulwe, Nerul, Seawoods, Kamothe, Kharghar, Panvel, Belapur, Vashi, and Airoli.

We are a technology platform and intermediary. We do not act as a real estate agent, broker, legal advisor, or financial advisor. All property transactions are directly between buyers/renters and sellers/owners. HomesBuyer is not a party to any such transaction.

Additional services include: property listing management, lead generation, home services directory, EMI calculator, and property comparison tools.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

Buyers & Renters: You may search properties, save favourites, and submit lead enquiries. By submitting a lead, you consent to being contacted by the assigned broker or property owner. You must provide accurate contact information.

Property Owners: You may list your own properties. You are responsible for the accuracy of listing details including price, photos, and availability. You must not list properties you do not own or have authority to list.

Brokers: You must be a licensed real estate professional or operate within applicable RERA guidelines. You are responsible for the accuracy of listings you post. You must respond to assigned leads within the platform's response window.

All Users: You must be at least 18 years of age. You are responsible for maintaining the confidentiality of your account credentials. You must not share your OTP with anyone.

All property listings are subject to admin approval before going live. We reserve the right to reject, edit, or remove any listing that violates these Terms.

Prohibited Content: Fake or duplicate listings; properties not located in the stated area; misleading photos (stock images, other properties); prices significantly below or above market rate without justification; phone numbers or contact details in listing descriptions; RERA-non-compliant claims.

Photo Requirements: Listings without photos may be deprioritised. Photos must be of the actual property. Using photos from other listings is prohibited and may result in account suspension.

Listing Freshness: Listings that have not received leads in 30+ days may be marked as stale. Brokers are encouraged to refresh listings regularly.

Approved listings are indexed on search engines. Removing a listing does not guarantee immediate removal from search engine caches.

Lead Submission: When a buyer submits a lead form, their contact details are shared with the assigned broker or property owner. This is the intended use of the Platform.

Contact Limits: Brokers may contact a lead a maximum of 3 times within 7 days unless the buyer initiates further contact. Harassment or spam calling is strictly prohibited.

DPDP Consent: All lead forms include a DPDP consent checkbox. By submitting a lead, buyers consent to being contacted by the assigned party.

Lead Routing: Leads are assigned based on listing ownership, broker availability, and performance metrics. HomesBuyer reserves the right to reassign leads if a broker is unresponsive.

Spam Protection: We use automated spam scoring to filter fake leads. Leads with a spam score above 80 are blocked. Sequential mobile numbers (e.g., 9876543210) are automatically flagged.

Free Plan: Every registered broker receives 3 free listing credits. Free plan brokers can post up to 3 properties.

Paid Plans: Monthly (₹999), Quarterly (₹2,499), and Yearly (₹7,999) plans are available. Paid plans provide additional listing credits and features.

Refer & Earn: Brokers who refer another broker receive 2 free months when the referred broker posts their first listing.

Refunds: Subscription fees are non-refundable once the plan period has started, except in cases of platform failure or duplicate charges.

Plan Expiry: Upon plan expiry, listings remain visible but new listings cannot be posted until the plan is renewed or free credits are available.

Pricing is subject to change with 30 days notice to existing subscribers.

You must not: post fake, duplicate, or misleading property listings; use the Platform for money laundering or fraudulent transactions; scrape, crawl, or extract data from the Platform without written permission; attempt to reverse-engineer, hack, or disrupt the Platform; create multiple accounts to circumvent restrictions; post contact details in listing descriptions; harass, threaten, or abuse other users or Platform staff.

Violation of these prohibitions may result in immediate account suspension, permanent ban, and/or legal action.

All content on the Platform — including the HomesBuyer brand, logo, design, code, and editorial content — is owned by HomesBuyer and protected by copyright law.

Property photos uploaded by users remain the property of the uploader. By uploading photos, you grant HomesBuyer a non-exclusive, royalty-free licence to display them on the Platform.

You must not use HomesBuyer's brand, logo, or content without written permission.

The Platform is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or availability of any listing.

We are not responsible for any transaction, dispute, or loss arising from the use of the Platform. All property transactions are between the buyer/renter and the seller/owner.

We do not verify RERA registration of all listed properties. Buyers are advised to independently verify RERA status before making any payment.

To the maximum extent permitted by law, HomesBuyer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim.

These Terms are governed by the laws of India, specifically the laws of the State of Maharashtra.

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Navi Mumbai, Maharashtra.

We encourage users to first attempt resolution through our Grievance Officer (support@homesbuyer.in) before initiating legal proceedings.
